Terms & Conditions
Allotment
(a) The allotment of the MINDS Unit of the RRG shall be made strictly
at the sole discretion of the company.
(b) Application for Allotment may be rejected by the company without
assigning any reason and without any prior intimation to the intending allottee.
(c) If the Unit applied the first preference by the intending allottee
is not available or Company is otherwise unable to allot that Unit
to the intending allottee in such a case other Unit applied in
the order of preference of the intending allottee shall be
allotted subject to availability.
(d) The applicant can purchase at least 10 MINDS units or in any
multiple thereof. However, allottee shall be entitled for allotment
of plot/certificate (witch shall be marketable) only on acquiring
at least 100 MINDS units. Units shall be allotted to applicant on
100% payment of the unit price.
Information
(a) The intending allottee has inspected the title documents of
the land and has also inspected Reservation Letters issued by the
JDA and is fully satisfied about the same.
(b) The intending allottee has applied for the allotment of Unit
at RRG with full knowledge and subject to all laws, notifications
and applicable rules, which have been explained by the Company and
understood by the intending allottee. The intending allottee has
seen, inspected and understood the terms and conditions enumerated
in draft of “Buyers Agreement.”
Mode of Payment
All payment shall be made either through cash or cheque / bank draft / pay order payable at Jaipur in the name of "Finetech Developers Pvt.Ltd. A/C MINDS". Cheque / bank draft / pay order shall be subject to clearance. Outstation Cheque shall not be accepted. The Company shall not be responsible for payments made through any other mode.
Joint Application
Joint application by more than one intending allottee shall be acceptable to the Company.
Correspondence
All Correspondence shall be made at the address given in the application from until
the same is changed and informed to the office of the Company .
Duties & Taxes
(a) All taxes levies, duties whether belonging to the Central Government,
State Government or local body levied in present or accruing in
future on the Unit allotted at RRG Shall be borne by the intending
Allottee(s).
(b) Stamp duty and registration charges in respect of the lease
deed of the Plot / Unit allotted to the intending allottee shall
be paid and borne by the intending allottee.
(c) All the relevant rules and regulations, notification of the
Govt. or any other statutory body which are presently applicable
or which may be applicable in future shall also be binding on the allottee.
Sale & Purchase
MINDS units can be sold and purchased from company's sale counter. Company will declare sale and purchase rate of Units on daily basis after the lapse of 6 months from the date of launch of the concept.
No units shall be bought back by the company before completion of 180 days from the date of issue of allotment certificate of units.
Possession
(a) Possession of the plots shall be given to the allottee(s) after JDA's allotment
of plots to Company. No date or time period for possession is being
committed by the company. (b) If the unit holder would not possess
100 units at the time of exit / closer of scheme, he / she / they
will be bound to surrender the units held by them to company for a
consideration based on the prevailing market price determined by the company. (c) Scheme shall be treated
closed when allotment of plots to all eligible unit holders will
be completed. Allotment shall be made through lottery with complete transparency.
Transfer
The intending Allottee(s) can transfer his / her / its units to any other
person and also shall be entitled to get the name of his / her /its nominees(s) substituted in his/her/its place with the prior
approval of the
Company, who may in its sole discretion permit the same on such conditions
as it may deem fit. However, such transfers shall entail administrative
charges @ Rs.10.00 per unit at present and can be revised by the
company any time without informing to unit holder(s).
Disputes & Arbitration
In respect of any dispute arising between the parties relating to
this agreement on any matter whatsoever, the same shall be settled
in accordance with the provisions of the India Arbitration &
Reconciliation ACT, 1996 and the statutory modifications thereof.
The venue of the arbitration shall be at Jaipur. The law courts
at Jaipur shall alone have exclusive jurisdiction to entertain the
disputes between the parties hereto.
Declaration
I / We hereby declare that I / We have fully understood all the
terms and conditions given to fully abide by the same.
I/ We further declare that the information in the application from
is true & correct to the best my / our knowledge and nothing
material has been concealed.
